Legal

Events happening in the community are now at Drupal community events on www.drupal.org.
This group should probably have more organizers. See documentation on this recommendation.

This is a working group for legal issues relating to Drupal. That includes licensing questions and planning. It should not be used as a legal advice forum; for that, consult a lawyer. If you actually have information from a lawyer about an issue that would be relevant to Drupal, however, that would be welcome.

Please be sure to read the FAQ before posting!

Partial use of its logo Druplicon

Hello.
I am a private entrepreneur from Russia, engaged in the development and use of sites in Drupal. For my work I have produced a logo and print to stamp, which is partly used image Druplicon.
I read that I need to obtain permission from the owner of the rights to use the image of Druplicon, in some cases.
Could you help me to determine the necessity of getting permission for this logo usage?
My logo = http://dl.dropbox.com/u/1032791/drupalkot_mini.png
My stamp = http://dl.dropbox.com/u/1032791/drupalkot-tatu5.png

Thank you.

drupal lisences with PHP extensions

Hi All,
I know there have been people trying to find loopholes in the lisencing in order to distribute their software without having to give away code, i guess there are some people who need this functionality for genuine needs.

If i was to write a php extension that returns a string to say a hook in the drupal system, would i then be required to distribute the source code to that extension, or would that extension fall under the lisencing of PHP.

Sell theme and code/dbase?

I developed a specific drupal theme. I plan to sell this theme, but it's not much use unless I also sell custom views and panels I built for it. Can i sell this together in a bundle?

What does "source code" include?

In a recent business partnership separation with another company, we received the "source code" for 30 websites that we developed with the other partner. All of the themes that were developed for these clients were based on Marinelli, however were modified according to specs that the clients agreed to in the design phase of the project. The language of the contract was vague other than to state we received "Source Code" of these sites and we were wondering if the final themes were included in that under the GPL?

Class file using MIT license

Hi,

This page http://drupal.org/node/915528 (Swedish social security/corporate identity numbers) has an attachement of a class file that is licensed under MIT.

My question is if I can incorperate it in my module and distribute it here as a project or must I provide a link to the original file (not the above one) for the user to download and install in for example "libraries"?

What defines distribution?

I can not really find clear answers to these questions. I know that when employees working on code that is not distribution.

Do any of these constitute distribution?
1) If a client wants to review the code before the project is finished.

2) The code is hosted with a company and that company can access the code.

3) A third party is hired by client to build another part of the site they get access to the code. Can they keep it and redistribute it?

You have error inside FAQ about GPL.

from point 7:
However, when distributing your own Drupal-based work, it is important to keep in mind what the GPL applies to. The GPL on code applies to code that interacts with that code, but not to data. That is, Drupal's PHP code is under the GPL, and so all PHP code that interacts with it must also be under the GPL or GPL compatible. Images, JavaScript, and Flash files that PHP sends to the browser are not affected by the GPL because they are data.

above is NOT TRUE.

Intellectual property rights with usage of ISO 639 and ISO 3166

This is a cross-post from http://drupal.org/node/1436736

As the maintainer of the countries module (and from trying to push the core D7 country list to comply with the latest release of the standard), I am wondering to what level that this standard can be used, it's usage, etc. This really effects Countries API and Countries modules, and about 10 other modules to some degree and also core Drupal 7 & 8.

From the original thread:

ISO 3166-1 - the list of countries.
ISO 639 - the list of languages.

Licence on database and whole drupal installation

I am wondering how is this solved. All the code is under GPL, what about database when created, what is licence on that by default?

My real question is, I am making a specific type of drupal site, site with specific modules, views that are setup and theme. But I would like to sell it like, people sell Fiverr script clone (for example).

Can I do that legally?
If so, how could I make it illegal for people to resell it and use it?

A question about dual-licensed Druapl modules

I'm seeking some advice around licensing for my software and Drupal. Thanks in advance to those who offer their opinion!

1.) I created and own a standalone, commercial, script. It can run as a php web application in its own right (no linking to any 3rd party software).

A Drupal user is selling downloads of a module I wrote for $49

The module is uc_authorizenet_multi (sandboxed) and is being sold here by Drupal user crossmedia.

Does this violate GPLv2? Specifically clause 2-b:

"You must cause any work that you distribute or publish, that in whole or in part contains or is derived from the Program or any part thereof, to be licensed as a whole at no charge to all third parties under the terms of this License."

Can developers legally obfuscate the code or use ioncube to protect code and sell?

Is it legal to obfuscate or ioncube encrypt the files and sell them? The code can technically be modified in either case. It's not compiled. I have a feeling I know the answer to this but, thought I'd make sure and cross it off the list.

Confused: GPL Compatibility of Drupal.org's Modules to External Obfuscated Online Services

KeyCAPTCHA external service is based on KeyCAPTCHA plugin(s), installed on protected web site servers.
This plug-in provides running the obfuscated client-side JavaScript (or ActionScript, if browser is not HTML5-compatible) coming from keycaptcha.com back servers.

Since these KeyCAPTCHA plugins are also published as Drupal.org modules (or extensions?) in http://drupal.org/project/keycaptcha, they are under GPL.

GPLv2+ Need clarification

How strict is Drupal's GPLv2+ licensing policy? I've read numerous threads and reviewed lots of code, but it's still unclear.

Points of confusion:

  • I see lots of code that's GPLv3-only or GPLv2-only in core and in contrib modules and themes. Yet http://drupal.org/licensing/faq/#q13 seems to indicate that such code is not in compliance.
  • How is the MIT license interpreted by the Drupal-sphere in terms of compatibility and integration? I'm specifically wondering about versions of the MIT license that permit sublicensing.
