The Client said they wanted the site to look like http://www.evernote.com and I think it looks pretty close.

yeah that's pretty close... dangerously close. well, good on ya for saying it before someone else did tho. but you really don't want to end up in ignominy on http://pirated-sites.com/vanilla/ look at some of the examples there, and see if your own site could end up there.
it's tough when i client says to make a design look like X. you have to do a certain amount of interpretation, especially to keep from simply copying someone else's work. i think you could have gotten the essence of the design without specifically matching colour for colour and element for element. i'm ducking as i write this- but you did ask for feedback, so i think you may be going through a quandry.
i had the two sites opened in tabs in my browser, and i could see the background image design was a modified copy; with the blocks in the same pixel position, and only altered. it's a fine point, but the kind of thing that graphic designers get really sad about.
in terms of your execution of the design, all elements on the left margin should be the same distance from the edge; including the rss icon, the text in the title, the body and the menu. same goes for the right side, down to the credits link. same margin all round.
you're using verdana on the title, which means you have a total of 3 typefaces... i think you should make that title match the body text. it stands out. it's also too "big"... the text itself and the padding. this means the dotted right border seem too tall, and proportionately, the text itself looks too large. maybe use the same text you have for subtitle (e.g.,"services") on other pages.
the menu "Physicians Services Clinical Trials" pops up 1 pixel above the white area- in safari.
and the bottom menu? are you going to make it horizontal?

I'd just like to add that it is pretty much (visually) a straight rip of that site - to the point that I think a law suit could be pretty successful if Evernote chose to pursue it. Especially with your post that admits to copying it. Either way, I don't feel you did any interpretaion of the design into a unique offering for your client, and that is wrong. They don't have the right to request a carbon copy of it and you don't have the right to offer it to them. I'm not trying to sound self-righteous or anything. But as a designer this type of thing offends me.
Maybe you could work out a way to make an inspired design that was original, and pitch it to your clients as the right thing to do?
Please don't be personally offended by my remarks. I appreciate the Drupal/Zen community, and I'd love for this remark to be received as encouragement to improve and strive for excellence.

In the future if you don't want someone to be personally offended then you should probably ask them for clarification before you make statements like this.
I completely understand your point and if you read my clarification you will see that the site isn't done yet. Just by ending a comment with Please don't be offended doesn't mean you can say anything you want before that. If you will notice that heather made the same point but left room for me to explain and did it in a nice way. Remember that people write on forums so be nice :)

No I am not offended, neither do I plan to rip off the design :) I did copy the colors and background image for a space filler but that will be changed later before the site goes live with the colors from the clients original site. Don't know what I will do for a background yet. (Any ideas are welcome)
The site is a different width and uses different radius on the corners. When I am done the only thing that will be the same is the idea of two top menus, with the bottom being in tabs. (and mine are not images like evernotes) so not much to get excited about there.
Thanks for the tip about the margins and the fonts that would look better. I really dont know if I will worry about the 1pixel in safari unless anyone knows a quick fix for that.
I guess I should have clarified that the colors and bg were temporary.
It was just fun to see if I could replicate a great design with zen.

To be fair I think I could easily pick out at least 50 design points of difference just for the homepage. Neither site was what I would call highly original or unique, nor has the apparent clone ripped of a trademark or similar. To say a lawsuit is possible is silly, from a designers point of view they are but vaguely similar, not even close to my eye.
Lacks warmth
My bigger criticism of the site is that it lacks warmth. For a cancer treatment center, to me it seems kind of bleak, not really inspiring optimism.
I see from the picture there's a lot of natural wood in their center. Have you thought of using that as a background instead of grey?
